Podmínky poskytování právních služeb, včetně odměňování za právní služby se obecně řídí zákonem o advokacii (zák. č. 85/1996 Sb., v platném znění) a advokátním tarifem (vyhláška Ministerstva spravedlnosti ČR č. 177/1996 Sb., v platném znění). Na základě uvedených právních předpisů je možné sjednat odměnu za poskytnutí právních služeb jako smluvní, není-li odměna mezi advokátem a klientem takto sjednána, uplatní se ustanovení advokátního tarifu o mimosmluvní odměně.
Preferujeme smluvní odměnu za poskytované právní služby, přičemž při jejím sjednávání vždy přihlížíme k individuálním potřebám klienta a k předpokládané složitosti dané kauzy. Odměna za poskytování našich služeb je obvykle sjednána jako hodinová sazba, kdy je klientovi účtována dohodnutá částka za každou započatou hodinu poskytování právních služeb. Celková částka za poskytnuté služby je obvykle klientovi fakturována každý kalendářní měsíc nebo po skončení dané kauzy, dle vzájemné dohody. Obvyklá hodinová sazba se podle složitosti kauzy pohybuje v rozmezí od 150 do 300 EUR za hodinu (částka je uvedena bez DPH).
Podmínky ukončení: advokát je oprávněn smlouvu o poskytování právních služeb vypovědět v případě, dojde-li k narušení nezbytné důvěry mezi ním a klientem nebo neposkytuje-li klient potřebnou součinnost, nebo pokud klient přes poučení advokátem o tom, že jeho pokyny jsou v rozporu s právním nebo stavovským předpisem, trvá na tom, aby advokát přesto postupoval podle těchto pokynů, nebo nesložil-li klient přiměřenou zálohu na odměnu za poskytnutí právních služeb, ačkoliv byl o to advokátem požádán.
Upozorňujeme, že Česká advokátní komora byla dne 5.2.2016 pověřena Ministerstvem průmyslu a obchodu ČR mimosoudním řešením spotřebitelských sporů pro oblast sporů mezi advokátem a spotřebitelem ze Smluv o poskytování právních služeb. Internetová stránka tohoto pověřeného subjektu je www.cak.cz.
The provision of legal services, including remuneration, is generally governed by the Act on the Legal Profession (Act No. 85/1996 Coll., as amended) and the Lawyer's Tariff (Regulation No. 177/1996 Coll., as amended). A contractual fee can be agreed between lawyer and client; in its absence, the Tariff provisions on non-contractual fees apply.
The fee for services is typically negotiated on an hourly basis. The total amount is invoiced monthly or upon conclusion of the case, as agreed. Depending on complexity, the normal hourly fee ranges between EUR 150-300 (excluding VAT).
The lawyer is entitled to terminate the contract if the necessary trust is breached; if the client fails to provide necessary assistance; if the client insists on instructions that violate legal or professional regulations; or if the client fails to pay an adequate advance fee when asked. The client is entitled to terminate the contract at any time, without explicit reasons; termination takes effect upon receipt by the lawyer.
Consumers are advised that on 5 February 2016, the Ministry of Industry and Trade vested in the Czech Bar Association the responsibility for out-of-court settlement of consumer disputes arising out of contracts to provide legal services. The website of the responsible entity is www.cak.cz.
This document governs how Mgr. Petr Horáček, LLM, attorney registered with the Czech Bar Association under No. 15933, with registered office at Na Zbořenci 276, 120 00 Prague 2, IČ: 87028115 (hereinafter "the attorney") handles personal data.
As controller of personal data provided by the client under the engagement agreement, the attorney undertakes to process such personal data in accordance with applicable law, in particular Act No. 85/1996 Coll. (the Legal Profession Act) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR).
The controller is the attorney. The legal basis for processing is the legal services agreement; processing takes place for the purpose of providing legal services under that agreement. The client is not obliged to provide personal data, but without it a legal services agreement cannot be concluded; the client will always be informed of the specific consequences of failing to provide data.
The attorney has not appointed a data protection officer, as he is not a public authority or public body, his principal activities do not consist of processing operations requiring large-scale regular and systematic monitoring of individuals, nor of large-scale processing of special categories of data.
The attorney processes personal data using his own means, protecting it by mechanical, electronic and organisational security measures, in electronic form by automated means or in printed form by non-automated means; no automated individual decision-making takes place.
Where necessary for the performance of the engagement, personal data may be accessed by third parties such as public authorities (e.g. courts, administrative bodies), information system maintenance providers, and other recipients as required by the client's needs and instructions. In such cases the attorney will implement contractual, technical and organisational measures to ensure that personal data are processed only to the extent necessary and exclusively in accordance with applicable law.
In certain cases the attorney processes personal data to comply with legal obligations, e.g. tax and statutory duties. Where required by applicable law, the attorney may be obliged to disclose personal data to administrative or supervisory authorities. The attorney does not intend to transfer personal data to a third country (outside the EU) or to an international organisation.
Personal data will be retained for the duration of the legal services agreement and thereafter in accordance with applicable law, in particular Act No. 85/1996 Coll., Act No. 499/2004 Coll. (the Archive and Records Management Act), and the GDPR.
Right of access: The client has the right to obtain from the attorney information on whether personal data concerning the client are being processed, and if so, what data and in what manner. The client also has the right to have inaccurate personal data corrected without undue delay, and to have incomplete data completed at any time.
Right to erasure: The client has the right to require the attorney to erase personal data being processed about the client, provided the relevant conditions are met and the client so requests.
Right to restriction of processing: The client has the right to require the attorney to restrict the processing of personal data in certain circumstances. The client may object at any time to processing based on the attorney's legitimate interests, a third party's legitimate interests, or the performance of a task in the public interest or the exercise of official authority.
Right to data portability: The client has the right to receive personal data provided to the attorney in a commonly used, machine-readable format, and to transmit those data to another controller, or, where technically feasible, to have the attorney transmit them directly.
Right to withdraw consent: This right does not apply, as the client's personal data are processed on the basis of the contractual relationship, not on the basis of consent.
If the client is dissatisfied with the processing of personal data by the attorney, the client may lodge a complaint directly with the attorney or with the Office for Personal Data Protection (uoou.cz). Further information on client rights is available at uoou.cz.
Information must be provided free of charge and without undue delay, in any event within one month of receipt of the request. Where the request is submitted electronically, information will be provided in electronic form unless the client requests otherwise. The identity of the person submitting an electronic request will always be verified before information is disclosed. Requests may be submitted using the form available at cak.cz.
All requests from data subjects must be handled in accordance with legal profession rules. In particular, the processing of such requests must not compromise the principles governing the exercise of the legal profession, especially the duty of confidentiality under § 21 of the Legal Profession Act. Given the broad scope of legal professional privilege, the attorney will in many cases be unable to comply with a data subject's rights even in part - he will be unable not only to provide specific information about processing or copies of records, but also to confirm whether any information is being processed at all, or to identify its origin.
